Terms of Use and Sale
These terms govern use of arcwearable.com, ARC accounts and support services, and supplement the purchase-specific terms shown when an ARC order is placed. By using the services, you agree to these terms to the extent permitted by applicable law.
Company
ARC services are operated by Arc Wearable, Inc; references to ARC, we, us or our in these terms mean Arc Wearable, Inc.
Eligibility and accounts
You must be legally able to enter into the transaction you request. You are responsible for keeping account credentials and access links secure and for providing accurate information needed to support your account and orders.
Product status
ARC Band and ARC Ring are consumer wellness products. Current product pages state the specifications, compatibility, certifications, pricing and purchase terms for the products offered for sale.
Orders and payment
Checkout and payment verification are handled through MemberConsole and its payment providers. An order is subject to the price, taxes, shipping charges, product details and purchase-specific terms shown during checkout. ARC may refuse or cancel an order where reasonably necessary for fraud prevention, inventory limits, pricing errors or legal compliance, subject to applicable law.
Order records and communications
Order confirmations, receipts, account notices, shipping updates, support replies and other transaction-related communications may be delivered electronically using the contact information associated with the order or account. Keep that information current so ARC can provide order-related notices.
Shipping, returns and warranty
The Shipping, Returns and Warranty pages form part of these terms for ARC orders. Purchase-specific terms control if they provide more specific conditions. Nothing in these terms limits consumer rights that cannot legally be waived.
Wellness disclaimer
ARC products and software are intended for general wellness and fitness. They are not intended to diagnose, treat, cure or prevent disease, and should not be used as a substitute for professional medical advice or emergency services.
Acceptable use
You may not misuse ARC services, attempt unauthorized access, interfere with security or availability, reverse engineer protected service components where prohibited by law, use the services to violate another person's rights, or use automated methods in a way that materially disrupts the service.
Intellectual property
ARC site content, software, product design, graphics, trademarks and other protected materials are owned by Arc Wearable, Inc or its licensors. These terms do not transfer ownership of ARC intellectual property to users.
Third-party services
ARC may rely on third-party services for checkout, payment processing, authentication, hosting, communications, analytics, fulfillment or optional integrations. Those services may have their own terms and privacy practices.
Service availability
ARC may modify, suspend or discontinue features where reasonably necessary for product development, security, legal compliance or operations. ARC will not use this clause to remove rights that have already vested under an accepted order or applicable law.
Disclaimers and liability
To the maximum extent permitted by law, services are provided subject to the written promises that apply to them and otherwise without implied guarantees beyond those that cannot legally be excluded. Any limitation of liability applies only to the extent allowed by applicable law and does not exclude liability that the law does not permit ARC to exclude.

The mailing address is a corporate mailing address and is not a product return center unless ARC provides written return instructions.
Severability and enforcement
If a provision of these terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive the right to enforce it later.
Changes to these terms
ARC may update these terms as products and services change. Updated terms apply prospectively from the posted effective date unless applicable law or an accepted purchase agreement requires a different process.
